By accessing or using YPOSER (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy, which describes how we collect and use your data. If you do not agree to these terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, by email or in-app notification, except where changes are required by law or necessary to address security concerns. If you do not agree with the updated terms, you may close your account before the changes take effect. Continued use of the Service after the notice period constitutes acceptance of the new terms.

YPOSER is an AI-powered image manipulation platform providing:

• Product on Model: Virtual try-on for e-commerce
• Pose Transformer: AI-powered pose manipulation
• AI Image Editor: Intelligent image editing
• Flow Switch: Workflow chaining capabilities

All images produced by the Service are generated or modified by artificial intelligence. We do not use your uploaded images to train our AI models. AI-generated outputs should not be represented as human-created photography where such misrepresentation would be misleading or prohibited by law.

All images produced through YPOSER are generated or modified by artificial intelligence. For full details on the AI models we use, your responsibilities when sharing AI-generated content, and our EU AI Act compliance, see our AI-Generated Content Disclosure.

To use YPOSER, you must create an account using one of our supported authentication methods (Google Sign-In or email verification). You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us of any unauthorized use

You must be at least 18 years old to use this Service.

YPOSER operates on a credit-based system. Credits are required to generate images. All prices are displayed in EUR. Subscription credits reset each billing period — unused subscription credits do not carry over.

Subscriptions:

• Subscription fees are charged at the start of each billing period (monthly or annual)
• After the withdrawal period (see Right of Withdrawal below), subscription fees are non-refundable — you retain access until the end of your current billing period
• You can cancel your subscription at any time through the billing portal — cancellation stops the next renewal but does not trigger a refund for the current period

Top-up credits:

• Unconsumed top-up credits may be refunded if the purchase was made within the last 7 days
• Credits that have already been used cannot be refunded

To request a refund for eligible top-up credits, email help@yposer.ai within 7 days of purchase.

7-day satisfaction guarantee: If you have never previously held a paid YPOSER subscription, you may request a refund of your first subscription (monthly or annual) within 7 days of purchase by emailing help@yposer.ai. The refund is pro-rata based on unused credits — credits already consumed are non-refundable.

Prices are subject to change with at least 30 days' notice. Any price changes will not affect your current billing period.

In addition to subscription credits, users may purchase top-up credit packs at any time. The following packs are available:

• Mini — 200 credits — €5
• Starter — 1,000 credits — €20
• Growth — 2,750 credits — €50

Top-up credits expire 12 months after purchase. They are consumed only after your subscription credits are exhausted each billing period. Unconsumed top-up credits may be refunded within 7 days of purchase — see Billing & Payment above for details.

You agree NOT to use YPOSER to:

• Generate illegal, harmful, or offensive content
• Create deepfakes or non-consensual intimate images
• Infringe on copyrights, trademarks, or other IP rights
• Harass, defame, or harm others
• Spread misinformation or deceive others
• Attempt to reverse-engineer or exploit the Service
• Violate any applicable laws or regulations

Violation of these terms may result in immediate account termination without refund.

Your Content: You retain ownership of images you upload. By uploading, you grant YPOSER a limited license to process your images for service delivery.

Generated Content: You are granted an exclusive, perpetual, worldwide license to use, modify, reproduce, and distribute images generated through the Service. To the extent AI-generated images are eligible for copyright protection under applicable law, we assign and transfer any such rights to you. Where AI-generated images are not eligible for copyright protection, your rights are governed by this license.

Commercial use rights depend on your subscription plan:

• Free plan: Personal and non-commercial use only
• Pro plan: Full commercial use, including e-commerce, marketing, and publications
• Max plan: Full commercial use, including e-commerce, marketing, publications, and enterprise contexts

Licenses granted under this section are revoked for any content generated in violation of these Terms.

Our IP: YPOSER, its logo, features, and technology remain our exclusive property. You may not copy, modify, or distribute our intellectual property.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

• We do not guarantee uninterrupted or error-free service
• AI-generated results may vary in quality
• We are not responsible for third-party content or links

This disclaimer does not affect your statutory rights as a consumer under applicable EU law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YPOSER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability shall not exceed the amount you paid to YPOSER in the 12 months preceding the claim.

We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to: infrastructure outages, third-party AI service disruptions, natural disasters, government actions, or internet connectivity failures.

Nothing in this section excludes or limits our liability where it cannot be limited under applicable law, including liability for wilful misconduct, gross negligence, or death or personal injury caused by our negligence.

We may suspend or terminate your account for violation of these terms. Where practicable, we will provide prior notice and a statement of reasons before taking action.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive will remain in effect. You may appeal a termination decision by contacting help@yposer.ai.

You have the right to request deletion of your YPoser account under GDPR Article 17.

How to request: email help@yposer.ai with the subject line “Account Deletion Request”.

Target turnaround: 30 days per GDPR Article 17. We may extend by up to 60 additional days for complex requests, and will notify you in writing if we do.

Identity verification: we will reply from help@yposer.ai asking you to confirm the request from the email address registered on your account.

Before you request: deletion is permanent and we cannot recover your data afterwards. If you want a copy of your images, prompts, or job history, request an export via the same email first (GDPR Article 20 — right to data portability).

What gets deleted: your account record, generated images, prompts, job history, Firebase authentication record, historical auth and security event logs keyed to your account, and your active YPoser subscription. Account deletion follows the same refund terms as cancellation — no refund is issued for the remaining billing period.

What is retained (legal-obligation carve-out under GDPR Article 17(3)(b)): payment records held by our payment processor, retained per applicable accounting law (typically 7 years; final figure pending finance and legal confirmation). These records are kept as financial ledger entries only.

Refusal or partial fulfilment: if a legal obligation prevents us from fulfilling your request in whole or in part, we will tell you why within the 30-day window.

Appeals: EU and UK users may lodge a complaint with their local data-protection authority (GDPR Article 77).

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 days of subscribing, without giving any reason.

To exercise your right of withdrawal, contact us at help@yposer.ai with a clear statement of your decision to withdraw.

Digital content exception: By subscribing and using the Service, you expressly consent to the immediate provision of digital content (credit allocation and image generation). You acknowledge that you lose your right of withdrawal for credits that have been consumed (used to generate images) during the withdrawal period.

Unused credits: If you withdraw within 14 days and have not consumed all allocated credits, you are entitled to a pro-rata refund for unused credits.

If you are also eligible for our 7-day satisfaction guarantee, you may use either remedy, but not both for the same purchase.

Nothing in this section limits your statutory rights under applicable consumer protection law.

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict-of-law provisions.

Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Gothenburg, Sweden.

Nothing in these Terms affects your statutory rights as a consumer under applicable EU law, including the right to bring proceedings in the courts of your country of residence.

For EU consumers: you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YPOSER regarding the Service.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, with notice to you. You may not assign or transfer your account or rights under these Terms without our written consent.
